The Second Degree

Except Criminal Mischief in the 2nd Degree is no laughing matter.  The penal code of New York says this ...
Criminal mischief in the 2nd degree occurs when you act with intent to damage someone else’s property and actually damage it where the damage is valued at more than $1,500. 
Second degree criminal mischief is a Class D felony which carries a potential sentence of up to 7 years in prison.
Wow.  I don't want the guy to go to jail for seven years.  How about six months?  Plus an apology?  Then another year assigned to scrub graffiti off public buildings?

Someone on Facebook suggested he be required to stand in a public area for twelve hours and let people write stuff on him.  Which is a bit medieval, but hey.
